STAB VIDA provides the Dr Vida Pocket PCR mobile application (“App”) that will work in combination with Doctor Vida pocket equipment (“Equipment”) for diagnostic purposes. The User is the health professional who operates the App and the Equipment in order to perform the diagnostic of a disease.
STAB VIDA respects your right to privacy in the online domain, when you use our App and website, and communicate electronically with us. In this way, we developed this Privacy Policy to inform you how and why STAB VIDA process the personal data that you provide us through the App operated by STAB VIDA. By using this App, you are accepting the practices described in this privacy policy. If you do not agree to this privacy policy, please do not use this App. We reserve the right to make changes to this privacy policy at any time. Any changes will be posted in this privacy policy and material changes will generally apply to activities and data collected in the future. We encourage you to check this privacy policy regularly to ensure that you are aware of any changes and how your data may be processed. What is covered by this Privacy Policy?
This Privacy Policy applies exclusively to the processing of data, including personal data on the App. The App will be connected to Dr Vida equipment by Bluetooth to perform the diagnostic of a COVID-19 disease. After running the assay, a diagnostic report will be generated and results communicated to the National Health Authority when requested by the applicable law.
What is personal data?
According to the REGULATION (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data:
"personal data" means any information relating to an identified or identifiable natural person ("data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;
Who is responsible for data processing?
The entity responsible for the processing of personal data is STAB VIDA and in that context decides which data is collected, the means of processing the data and for what purposes are used.
What kind of personal data do we process and why?
Our App may need access to certain features, such as Internet, Location, Bluetooth, Camera and User and Patient personal data, in order to properly function. After installation and while running the App it will request the User for permission to access the required features and/or information. The User may deny the permissions but the App functionalities may become limited or even not possible to use. The features required for the App to run on your mobile phone and to connect with Dr Vida equipment to run assays are described below:
Internet
This permission is required to login and to transfer the assays data to the STAB VIDA server. The User may opt-out on this permission, however it will not be possible to use the App.
Location/Bluetooth
This permission is requested to allow the App to scan for nearby Dr Vida pockets equipments in order to pair and establish a Bluetooth connection with such equipments, allowing to control them and perform assays. This function may run in background to allow the App to keep track of Bluetooth connection status and maintain assay results data transfer, even if the user is performing other tasks in the mobile equipment. The User may opt-out on this permission, however the App will only be able to function partially:
- Perform an assay selecting “New assay with fast track”. This option will require camera permission, because it requires barcode reading.
- Access to Settings and Results menu.
Camera
This permission is requested to allow access to camera such that the User may scan the barcode provided with the device (for pairing), assay reagents (for registering the assay reference and lot number) and sample information (sample ID, patient name, health number, etc). The User may opt-out on this permission and, in this case, fill in the required fields manually.
Storage of Personal Data
This permission is requested to allow storage of information related to some app functions, such as personal data of the User and Patient which are required to generate a diagnostic report in compliance with the applied law (e.g. patient name, health number, health professional name, professional license, etc). The User and Patient may opt-out on this permission by providing only an anonymous sample ID. However, the diagnostic report will not be generated with the required information.
Storage of Registration Data
This permission is requested to allow the storage of data to identify the user when it accesses the App. The identification is done so the assay results and profile information of the user can be displayed. The user may opt-out on this permission. However, it will not be able to use the App.
Storage of Image and Information Data
These permissions are requested to allow the usage or storage of information and images to enable customization of assay certificates such as, the logotype of the organisation, name, signature and professional license of the Technical Director. This data is required to generate a diagnostic report in compliance with the applicable law. The User may opt-out on this permission, however, the diagnostic report will not be in fully compliance with the law.
When and how do we collect and process your personal data?
STAB VIDA collects your data through its website and App, with your consent. In a regular basis, personal data is collected when you install the App, upon registration and during the assay. Some personal data are mandatory and, in case of lack or insufficiency of these data, STAB VIDA cannot accept your registration or cannot process the assay when using in combination with the equipment Dr Vida pocket. In each case, STAB VIDA will inform the Users of the mandatory nature of the provision of personal data in question in which case the rules of this Privacy Policy will apply. The personal data collected are treated and transmitted in strict compliance with the legislation on the protection of personal data, and are stored in a specific database and in no case will the data collected be used for another purpose other than that for which the consent of the data subject was given.
What are the purposes of processing personal data?
In the App, the personal data collected and processed are intended for granting Users with exclusive access to use the equipment Dr Vida pocket to process assays.
How we handle data storage?
We receive data input into the App and/or website before it is then stored in cloud servers, which are located in France. We have implemented appropriate security measures and controls to protect personal information, such as using modern cryptography (HTTPS) to transmit the collected personal data.
How long do we keep your personal data?
The length of time during which the data is stored and preserved varies according to the purpose for which the information is processed. Effectively there are legal requirements that require data retention for a minimum period of time. We do regular backups of these data to our server and we also recommend you to make backups of your data in a regular basis. You can also decide to delete your account at anytime and all data associated with your account will be also deleted. However, be aware that this process is irreversible.
How can you access, rectify or oppose the processing of your personal data?
Under the terms of the Law of Protection of Personal Data, is guaranteed to the data subject the right to access, update, rectify or delete his or her personal data at any time. In the App, you can delete your account at anytime and all data associated with your account will be also deleted. What measures have been taken by STAB VIDA to ensure the security of your personal data?
STAB VIDA is committed to ensure the protection and the security of the personal data that are made available to us, and has adopted and implemented rules in this regard. Compliance with these rules is an undeniable obligation to all of those that legally access them. Notwithstanding the security measures adopted by STAB VIDA, we are obliged to alert all App and internet users that they should take additional security measures, namely to ensure that they use an updated android phone, PC and/or Browser in terms of properly configured security patches, with active firewall, antivirus and antispyware, and make sure about the authenticity of the mobile apps you install and websites you visit on the internet, and avoid websites whose reputation you do not trust.
How do we use Cookies?
"Cookies" are small software labels that are stored on your computer through the browser, retaining only information related to your preferences, not including your personal data. STABVIDA may use cookies to help determine the usefulness, the interest and the number of uses of its websites, allowing a faster navigation, eliminating the need to repeatedly enter the same information. The use of cookies is a normal practice among Internet websites, and most Internet browsers allow a user to accept, decline or delete cookies, in particular by selecting the appropriate settings in their browser. The App does not use cookies, however in case of future use, the cookies policy will be applied. Be aware that through your browser you can disable cookies for any website you visit.
How can you become aware of any changes to STAB VIDA's privacy policy?
STAB VIDA reserves the right at any time to make adjustments or changes to this Privacy Policy, these changes being duly publicized on the App and STAB VIDA website.
